Finaap is NOT a regulated financial services provider. We are not authorised or regulated by the Financial Conduct Authority (FCA). We do not provide financial advice, debt counselling, or act on your behalf with creditors or tax authorities. We provide tools to help you track and understand your own financial situation. For financial advice, please consult a qualified financial adviser.
1. Agreement to Terms
By accessing or using Finaap's services in the United Kingdom, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These terms are governed by the laws of England and Wales, including the Consumer Rights Act 2015, the UK GDPR, and the Data Protection Act 2018.
2. Description of Service
Finaap provides a financial wellness platform that allows you to:
- Track your income, expenses, and debts in British Pounds (GBP)
- Connect your bank accounts via Open Banking to view balances and transactions
- Connect to HMRC Making Tax Digital to view your tax information
- Calculate UK taxes (Income Tax, National Insurance, VAT)
- Generate financial reports and insights
- Set reminders for payment due dates
- Access a directory of FCA-authorised debt advisers
2A. Open Banking Services
Agent Disclosure
For Open Banking services, Finaap Ltd acts as an agent of Finexer Ltd, who is authorised by the Financial Conduct Authority under the Payment Services Regulations 2017 (firm reference number 925695) as an Authorised Payment Institution to provide account information services and payment initiation services. Finaap does not provide financial advice, debt management services, or act as a licensed credit broker.
When you connect your bank account via Open Banking:
- You authorise Finexer (via Finaap) to access your bank account information
- We access your account balances and transaction history (read-only)
- We cannot move money, make payments, or modify your accounts
- Your bank credentials are never shared with or stored by Finaap
- Consent is valid for 90 days and requires re-authentication at least every 90 days, in line with regulatory requirements under the Payment Services Regulations 2017
- You can disconnect your bank and revoke consent at any time
Data Usage: Your Open Banking data is used solely for:
- Displaying your account balances and transaction history
- Categorising transactions for budgeting and tracking
- Detecting potential recurring payments and debts
- Supporting your personal financial planning and tax record keeping
Your bank data is NOT used for marketing purposes and is NOT shared with third parties.
2B. Financial Insights and Scores
Finaap may generate financial insights, summaries, and a "Financial Pulse" based on your transaction patterns and financial data. These features are provided for your personal information only.
Important: Descriptive Use Only
All scores, insights, and summaries generated by Finaap are descriptive only and are presented solely for the user's own visibility and personal awareness. They are not used to assess eligibility, determine creditworthiness, evaluate risk, make recommendations, rank users, or support any automated or manual decision-making by Finaap or any third party. Finaap does not share these scores or insights with lenders, credit reference agencies, or any other external party.
3. What Finaap Does NOT Do
To ensure clarity and FCA compliance, Finaap does NOT:
- Provide financial advice: We do not recommend financial products, investments, or give regulated advice
- Contact creditors: We do not negotiate with banks, lenders, or bailiffs on your behalf
- Manage your debts: We provide tracking tools only - you manage your own finances
- File taxes on your behalf: We help you view and calculate taxes, but you submit to HMRC yourself
- Move your money: We have read-only access to connected accounts
- Guarantee outcomes: Financial results depend on your own decisions and actions
- Provide credit broking: We do not introduce you to lenders or credit providers
4. Account Registration
To use our services, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised use
- Be a resident of the United Kingdom (for this version of the service)
5. HMRC Making Tax Digital Integration
When you choose to connect your HMRC account:
- You authorise us to retrieve your tax information from HMRC via the Making Tax Digital API
- Your National Insurance number and tax data are stored securely and encrypted
- We display your tax calculations and obligations but do not submit returns on your behalf
- You remain responsible for filing accurate tax returns with HMRC
- You can disconnect your HMRC account at any time
Note: Finaap is a recognised software provider under HMRC's Making Tax Digital programme but is not affiliated with or endorsed by HMRC.
6. Payment Terms
For paid subscription plans:
- Prices are displayed in British Pounds (GBP) and include VAT where applicable
- Payments are processed securely via Stripe
- Subscriptions renew automatically unless cancelled
- You may cancel at any time, effective at the end of your billing period
- Refunds are provided in accordance with our Cancellation Policy and the Consumer Rights Act 2015
7. User Responsibilities
You agree to:
- Provide accurate financial information
- Use the service only for lawful purposes
- Not attempt to access other users' data
- Not use the service for money laundering, fraud, or other illegal activities
- Comply with all applicable UK laws and regulations
- Verify your own tax calculations before filing with HMRC
8. Intellectual Property
All content, features, and functionality of Finaap are owned by us and protected by UK and international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without prior written permission.
9. Limitation of Liability
9.1 General Disclaimer
To the maximum extent permitted by the laws of England and Wales, Finaap and its services are provided on an "as is" and "as available" basis without warranties, representations, or guarantees of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
9.2 No Liability for Your Financial Decisions
You acknowledge and agree that all financial decisions you make are entirely your own. Finaap provides tools and information to help you observe and understand your own financial data. Finaap does not advise, recommend, endorse, or direct any financial decision, action, or inaction. You are solely and exclusively responsible for:
- Any decision to pay, not pay, defer, accelerate, or otherwise manage any debt, bill, or financial obligation
- Any decision to spend, save, invest, or allocate money in any way
- Any decision to file or not file tax returns, or to rely on any tax calculation shown by the platform
- Any action or inaction taken based on any score, insight, summary, forecast, simulation, or other output generated by the platform (including the Financial Pulse and any sub-scores)
- Any consequences, losses, damages, penalties, interest, fines, legal costs, or other liabilities arising from any of the above
9.3 Financial Insights and Scores
All scores, insights, summaries, forecasts, simulations, categorisations, and other outputs generated by Finaap (including but not limited to the Financial Pulse, spending patterns, debt detection, what-if simulations, and affordability checks) are approximate, informational, and descriptive only. They may contain errors, inaccuracies, or omissions. They are not financial advice, credit assessments, risk evaluations, or recommendations. You must not rely on them as the sole basis for any financial decision. Finaap accepts no liability whatsoever for any loss, damage, cost, expense, penalty, or other liability arising directly or indirectly from your use of, or reliance on, any output generated by the platform.
9.4 Tax Calculations and HMRC
Tax calculations shown by Finaap are estimates only. You are solely responsible for verifying all tax figures independently before filing with HMRC or any other authority. Finaap is not liable for any HMRC penalties, interest, surcharges, investigations, assessments, or any other consequences resulting from late, incorrect, incomplete, or missing tax filings, whether or not you used Finaap to prepare them.
9.5 Open Banking Data
Finaap is not liable for any errors, omissions, delays, or interruptions in data received from your bank via Open Banking (Finexer), including incorrect balances, missing transactions, or misclassified payments. Please verify all imported data against your bank statements.
9.6 Exclusion of Damages
To the maximum extent permitted by law, Finaap, its directors, officers, employees, agents, and affiliates shall not be liable to you or any third party for any:
- Indirect, incidental, special, consequential, or punitive damages of any kind
- Loss of profits, revenue, savings, business, data, or goodwill
- Financial losses including but not limited to missed payments, accrued interest, penalty charges, debt collection costs, court costs, legal fees, or increased balances
- Losses arising from reliance on any score, insight, calculation, forecast, simulation, or categorisation generated by the platform
- Losses arising from third-party services including bank data providers, HMRC, Stripe, or any other integrated service
This exclusion applies regardless of the legal theory (contract, tort including negligence, strict liability, or otherwise), even if Finaap has been advised of the possibility of such damages.
9.7 Aggregate Liability Cap
In any event, Finaap's total cumulative liability to you for all claims arising out of or relating to these terms or your use of the service shall not exceed the lesser of: (a) the total amount you actually paid to Finaap in the 12 months immediately preceding the event giving rise to the claim, or (b) £100.
9.8 No Waiver of Your Responsibility
Your use of Finaap does not reduce, transfer, delegate, or in any way diminish your personal responsibility for your own financial affairs. You remain fully and solely responsible for all decisions, actions, and omissions relating to your finances, debts, taxes, and obligations, regardless of any information, score, or insight provided by the platform.
9.9 Statutory Rights
Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by the laws of England and Wales. These terms do not affect your statutory rights as a consumer under the Consumer Rights Act 2015.
10. Dispute Resolution
Any disputes arising from these terms shall be:
- First attempted to be resolved through our internal complaints process
- If unresolved, you may use the European Commission's Online Dispute Resolution platform or UK-based ADR
- Subject to the exclusive jurisdiction of the courts of England and Wales
11. Termination
We may terminate or suspend your account if you:
- Violate these terms of service
- Engage in fraudulent or illegal activity
- Fail to pay subscription fees when due
- Provide false or misleading information
You may close your account at any time by contacting us. Upon termination, your right to use the service ends, but certain provisions of these terms will survive.
12. Changes to Terms
We may update these terms from time to time. We will notify you of material changes by email or through a notice on our platform. Your continued use of our services after such modifications constitutes acceptance of the updated terms.
